Core elements of the guarantee during the COVID-19 pandemic include:

  • “Ensure that LGBTI people are not subjected to discrimination or fear retribution for seeking healthcare” (OHCHR)
  • Ensure that “measures to address the socio-economic impacts of the pandemic” take into consideration “vulnerabilities of the LGBTI people” (OHCHR)
  • Ensure that shelters and other services do not discriminate against LGBTI persons and that steps are taken “to include the LGBTI population” (OHCHR)
  • “Acknowledge that LGBT and gender-diverse persons are everywhere and that they are hard-hit by the pandemic” (Independent Expert on protection against violence and discrimination based on sexual orientation and gender identity)
  • “Support the work of LGBT civil society and human rights defenders and learn from their significant achievements” (Independent Expert on protection against violence and discrimination based on sexual orientation and gender identity)
  • “Protect LGBT and gender diverse persons from violence and discrimination . . . and prosecute perpetrators” (Independent Expert on protection against violence and discrimination based on sexual orientation and gender identity)
  • Assess indirect discrimination that “exacerbates stigmatization” (Independent Expert on protection against violence and discrimination based on sexual orientation and gender identity)
  • Ensure “representation . . . in the process of design, implementation and evaluation of COVID-19 specific measures” (Independent Expert on protection against violence and discrimination based on sexual orientation and gender identity)
  • Gather “evidence concerning the impact of COVID-19 on LGBT and gender-diverse persons” (Independent Expert on protection against violence and discrimination based on sexual orientation and gender identity)
